Terms of Service

1. Acceptance of Terms

By signing up or using ECOTEN HARDWARE TRADING (“we”, “our”, or “us”), you (“user” or “you”) agree to be bound by these Terms of Service (“ToS”) and our Privacy Policy. If you do not agree, do not use the platform.

These Terms apply to all services, including AI lead generation, lead messaging, and analytics features.

2. Account Registration

• Users must register using a valid email address.
• Only one account per email is allowed unless explicitly authorized.
• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate information and keep it updated.

3. Subscription & Free Trial

• New users receive a 3-day free trial with limited lead credits.
• After the trial ends, a recurring subscription begins automatically via Stripe unless canceled before the trial ends.
• Subscriptions auto-renew monthly until canceled.
• No refunds are provided for subscription fees after the trial period.

4. Lead Credits & Usage

• One lead credit equals one lead searched for the user.
• Lead credits expire at the end of each month.
• Users must manage credits responsibly.
• Exceeding lead limits may result in blocked searches or additional charges.

5. Messaging Leads

• The platform sends messages on your behalf via email and WhatsApp.
• Users are solely responsible for ensuring they have the legal right to contact leads.
• You may not use the platform to send illegal, harassing, misleading, or fraudulent messages.

6. Acceptable Use & Prohibited Conduct

You may not use the platform to:

• Spread false information, spam, or fake news
• Violate any applicable laws or regulations
• Abuse the platform, interfere with its operation, or harm other users
• Circumvent system limits or manipulate credit usage

We reserve the right to suspend or terminate accounts that violate these rules.

7. Account Suspension & Termination

• We may suspend or terminate your account immediately for misuse, illegal activity, or breach of these ToS.
• Termination may include loss of lead credits or data, without refund.

8. AI Disclaimer

• The platform uses AI to generate messages and insights.
• AI outputs are estimates or suggestions and are not guaranteed to be accurate.
• Users are responsible for reviewing all AI-generated content before sending.

9. Platform Changes & Downtime

• We may update, modify, or temporarily disable services for maintenance or improvement.
• We are not liable for service interruptions, data loss, or errors resulting from platform changes.

10. Governing Law

• These ToS are governed by the laws of Malaysia.
• Any disputes will be resolved under Malaysian jurisdiction exclusively.

11. Limitation of Liability for Client Disputes

• You acknowledge and agree that ECOTEN HARDWARE TRADING (Blue1.my) is merely a tool provider and is not a party to any agreement, dealing, or transaction between you and your leads or customers.
• We shall not be liable for any disputes, claims, losses, injuries, or damage of any kind that may arise out of or in connection with your relationship with your customers or leads, including but not limited to any products or services you provide to them.
• You agree to indemnify, defend, and hold harmless ECOTEN HARDWARE TRADING and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including legal fees and costs, arising out of or in any way connected with your disputes with your customers.
